1. Agreement to Terms

By installing and using Production & Shipping Pro, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not install or use the app.

2. Description of Service

Production & Shipping Pro is a BigCommerce application that provides:

• Production time management and display
• Advanced percentage-based shipping rate creation
• Custom field styling templates
• Subscription billing services

3. Account Registration

To use the app, you must:

• Have an active BigCommerce store
• Complete OAuth authorization
• Provide accurate store information
• Maintain the security of your access credentials

4. Subscription and Billing

4.1 Subscription Plans

We offer three subscription tiers:

• Free: $0/month with limited features
• Pro: $29/month with unlimited features
• Enterprise: $99/month with API access and dedicated support

4.2 Payment Terms

• All paid plans include a 14-day free trial
• Billing is processed monthly via Stripe
• Prices are in USD
• Automatic renewal unless cancelled
• No refunds for partial months

4.3 Cancellation

You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. You will retain access until the end of the paid period.

5. Use Restrictions

You agree NOT to:

• Reverse engineer or decompile the app
• Use the app for illegal purposes
• Attempt to access other stores' data
• Abuse or overload our API endpoints
• Resell or redistribute the app
• Remove or modify any proprietary notices

6. Service Availability

We strive for 99.9% uptime, but we do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for service interruptions beyond our control.

7. Data Ownership

• Your Data: You retain ownership of all data you input into the app
• App Code: We retain all rights to the app's source code and intellectual property
• Export: You can export your data at any time via CSV

8. API Usage Limits

API rate limits apply based on your subscription tier:

• Free: 100 API calls per day
• Pro: 1,000 API calls per day
• Enterprise: Unlimited API calls

Exceeding limits may result in temporary throttling.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from BigCommerce platform changes
• Third-party service interruptions (Stripe, Heroku, etc.)

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Warranties Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the app or violation of these terms.

12. Changes to Service

We reserve the right to:

• Modify or discontinue features with 30 days notice
• Update pricing with 60 days notice for existing subscribers
• Change these terms with notification

13. Termination and Uninstallation

We may terminate or suspend your access if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Fail to pay subscription fees
• Abuse the service or API

What Happens When You Uninstall

When you uninstall the app, the following automatic cleanup occurs:

• Shipping methods are deleted - All shipping rates created by the app are removed from your BigCommerce store
• Production time fields are removed - Custom fields displaying production times are deleted from all products
• Your store returns to default BigCommerce shipping - No lingering configurations
• Data is preserved for 30 days - In case you want to re-install
• Permanent deletion after 30 days - Unless required by law

Important: Shipping methods and custom fields created by the app will NOT work after uninstallation. The automatic cleanup ensures your store doesn't have broken configurations.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these terms or use of the app shall be resolved through:

1. Good faith negotiation
2. Mediation if negotiation fails
3. Binding arbitration if mediation fails

17. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Production & Shipping Pro.
